Democrats slam Texas abortion pill ruling but are short on legislative solutions

Image
Senate Majority Leader Chuck Schumer called the ruling an "awful extreme and unprecedented decision." Top Democrats on Saturday slammed the ruling by a federal judge in Texas suspending the FDA approval of Mifepristone, though they were short on possible legislative solutions to protect access to the abortion drug. Senate Majority Leader Chuck Schumer and Washington Sen. Patty Murray looked to paint the controversial decision by U.S. District Judge Matthew Kacsmaryk as a political move meant to advance a Republican anti-abortion agenda. Kacsmaryk, a Trump-appointed judge, ruled regulators improperly approved the abortion pill mifepristone, one of the most common methods of abortion in the U.S., 23 years ago. The Department of Justice appealed the decision late Friday, with Attorney General Merrick Garland stating he strongly disagreed with Kacsmaryk's position. "This is an awful extreme and unprecedented decision. Let's be clear: This is about the Republica...

Massachusetts to stockpile abortion pill as legal dispute escalates

Image
Massachusetts Gov. Maura Healey says her state has begun stockpiling the abortion pill in anticipation that a court-ordered injunction could pull it from the market. Massachusetts Gov. Maura Healey on Monday announced her state has begun stock piling the abortion drug mifepristone ahead of a court-ordered injunction that could pull the drug from the market as early as Friday. It's a dramatic escalation in the fight over abortion rights that's pitted red states versus blue, and emboldened Democrats to look for novel ways to defy the potential nationwide injunction slated to go into effect at the end of the week. Under the governor's plan, Healy said the University of Massachusetts Amherst has already purchased 15,000 doses -- more than a year's worth of mifepristone for the state. Another $1 million from state coffers would be offered to Health care providers in the state to buy the drug before a nationwide injunction takes hold. The governor also said she will sig...

Most leading Republicans remain quiet on abortion pill ruling as Democrats blast decision

Image
Many Republicans have remained mum on a Texas federal judge's controversial ruling against the abortion pill mifepristone In the days after a federal judge in Texas ruled to reverse the U.S. Food and Drug Administration's approval of the widely used abortion medication mifepristone, Democrats have erupted in outrage. Republicans, who for years made abortion restrictions a centerpiece of their politics, have remained mostly mum on the issue that looks set for a Supreme Court showdown. Some in the GOP have suggested they are now on the "wrong side" of abortion, which polling has shown can be a leading issue to motivate voters -- against possible restrictions. By contrast, leading conservatives last June swiftly celebrated the Supreme Court striking down Roe v. Wade, praising the Dobbs v. Jackson Women's Health Organization decision as putting the issue of abortion back in the hands of the people -- in the states -- and not having it determined by the court. ...

With mifepristone in limbo, Harris reaffirms White House commitment to abortion access

Image
Vice President Kamala Harris reaffirmed the administration's commitment to abortion rights on Wednesday with a new rule under HIPAA to protect abortion patients' records. With Americans' access to the abortion pill mifepristone still in limbo, Vice President Kamala Harris on Wednesday convened a meeting of a White House task force on reproductive health care during which Cabinet officials expanded on a new way they intend to protect a person's privacy when it comes to abortion access. The meeting fell just hours after the Department of Health and Human Services announced it had drafted a new federal rule intended to make clear to doctors and other medical professionals that divulging details of a person getting an abortion violates the privacy law HIPAA. Harris explained that an exception written into the 1996 HIPAA law provides that if law enforcement officials needed information in pursuit of a criminal matter, they could access a person's medical records aft...

Justice Department to take abortion pill fight to Supreme Court: Garland

Image
This follows an appeals court ruling that would restrict access. The Justice Department on Thursday said it would take the fight over an abortion pill to the Supreme Court after an appeals court ruling that would restrict access to the widely-used abortion pill mifepristone. The appeals court ruling was set to take effect early Saturday morning. "The Justice Department strongly disagrees with the Fifth Circuit's decision in Alliance for Hippocratic Medicine v. FDA to deny in part our request for a stay pending appeal. We will be seeking emergency relief from the Supreme Court to defend the FDA's scientific judgment and protect Americans' access to safe and effective reproductive care," Attorney General Merrick Garland said in a statement. Florida House passes 6-week abortion ban, expected to be signed by governor

Image
The Florida House of Representatives voted to approve a six-week abortion ban to replace the state's 15-week ban. It now heads to Gov. Ron DeSantis for signing. The Florida House of Representatives on Thursday passed a six-week abortion ban that would replace the state's 15-week ban. The bill now heads to the governor's desk for his signature. Florida Gov. Ron DeSantis has said he would sign a six-week ban should it be sent to his desk. The ban would prohibit all abortions after six weeks of pregnancy, before most women know they are pregnant. The ban makes exceptions for when the woman's life or health is at risk and cases of rape or incest, under certain conditions. Even with its current ban in place, Florida has fewer restrictions compared to nearby states. Florida Gov. Ron DeSantis speaks at an event, April 6, 2023, in Hillsdale, Mich. DOJ asks Supreme Court for emergency stay in abortion pill fight

Image
An appeals court ruling restricting access was set to take place Saturday. The Justice Department on Friday asked the U.S. Supreme Court for an emergency stay of an appeals court ruling that would sharply restrict access to the widely-used abortion medication mifepristone. The restrictions were set to take effect early Saturday morning. On behalf of the FDA, DOJ has asked the court to impose an immediate administrative stay of the 5th Circuit's abortion pill decision -- to preserve the status quo while the justices consider the application -- but to ultimately stay the ruling pending appeal.
